These Terms and Conditions set out the basis on which Waste Clearance Clapham provides waste collection and clearance services to residential and commercial customers. By placing a booking or otherwise instructing us to carry out any waste clearance or related services, you agree to be bound by these Terms and Conditions.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, business, company or organisation that requests or receives waste collection or clearance services from us.
Services means any waste collection, removal, loading, transportation, recycling, disposal or related services provided by Waste Clearance Clapham.
Waste means any items, materials, rubbish, junk, debris or refuse that the Customer asks us to collect and remove, excluding any prohibited or hazardous waste unless expressly agreed in writing.
Booking means a confirmed request for Services made by the Customer and accepted by us via telephone, email, online form or other agreed method.
Waste Clearance Clapham provides waste collection and clearance services including, but not limited to, general household rubbish removal, bulky item collection, office and commercial waste clearance, garden waste removal and light construction waste collection, subject always to these Terms and Conditions and applicable waste regulations.
The specific nature and scope of the Services to be delivered will be agreed with the Customer at the time of booking, including the estimated volume and type of waste, the collection location, access arrangements and any particular requirements notified to us in advance.
We reserve the right to refuse to collect certain items, including any waste that is hazardous, prohibited by law, unsafe to handle, or significantly different in type or volume from that described at the time of booking.
A Booking can be made by contacting us using the communication methods we make available, such as by telephone or online enquiry. When making a Booking, the Customer must provide accurate and complete information, including the pickup address, type and approximate quantity of waste, access information, preferred date and time window, and contact details.
Any quotation given at the time of enquiry is based on the information supplied by the Customer. Quotations are an estimate only and are subject to change if, upon arrival, the waste is materially different in type, condition or volume from that originally described, or if access conditions are significantly more difficult than advised.
Bookings are deemed accepted and confirmed once we notify the Customer that the booking has been scheduled. We reserve the right to decline a Booking at our discretion, for example where we reasonably believe that the work cannot be carried out safely or lawfully, or where the Customer has previously failed to comply with these Terms and Conditions.
The Customer is responsible for ensuring that we have safe, reasonable and timely access to the property and to the waste that is to be collected. This includes ensuring that any necessary permissions for access are in place and that we are informed in advance of any access restrictions such as parking limitations, building security requirements, or time-specific access rules.
The Customer must ensure that the waste is clearly identified and is in a suitable condition to be safely handled by our team. We may refuse to collect waste that is contaminated, unsafe, or stored in a way that presents a risk to health and safety.
If we are unable to access the property or the waste due to circumstances within the Customer's control, we may apply a wasted journey or call-out charge, and any rebooking may be subject to additional fees.
Our pricing is typically based on factors such as the volume and type of waste, the labour involved, ease of access, and disposal or recycling costs. We may provide an estimated price range at the time of booking, subject to confirmation upon inspection of the waste at the point of collection.
All prices quoted are exclusive of any applicable taxes unless otherwise stated. We reserve the right to revise a quotation where the waste differs materially from the description provided by the Customer, where additional labour or time is required, or where unforeseen circumstances arise that affect the cost of providing the Services.
Any revised price will be discussed with the Customer before work continues. If the Customer does not agree with the revised price, we may cancel the Services and charge a reasonable call-out fee to cover our costs incurred to that point.
Unless otherwise agreed in writing, payment for the Services is due in full on completion of the collection, or in advance if requested. We may accept payment by cash, card or other payment methods as notified to the Customer at the time of booking or service.
For business Customers, we may agree credit terms, in which case invoices are payable within the timeframe specified on the invoice. Time of payment is of the essence. If payment is not received by the due date, we reserve the right to charge interest on the overdue amount at the statutory rate permitted under UK law, and to suspend or cancel any further Services.
The Customer is responsible for ensuring that payment details provided to us are accurate and that sufficient funds are available. We may charge the Customer for any bank charges or administration fees incurred as a result of failed or reversed payments.
The Customer may cancel or amend a Booking by giving us reasonable notice prior to the scheduled collection time. We request that Customers provide at least 24 hours notice where possible.
If the Customer cancels with less than 24 hours notice, we reserve the right to charge a cancellation fee to cover the costs associated with scheduling and allocating resources to the Booking. The amount of the fee will be communicated to the Customer and will be reasonable in the circumstances.
We may cancel or reschedule a Booking due to events outside our reasonable control, such as severe weather, vehicle breakdown, staff illness, safety concerns, or other operational issues. In such cases, we will notify the Customer as soon as reasonably practicable and rearrange the Booking at a mutually convenient time. We shall not be liable for any losses arising from such cancellation or rescheduling, provided we act reasonably and promptly to notify the Customer.
We comply with applicable UK waste regulations and operate under relevant licences or registrations required for the collection, transportation and disposal of controlled waste. We aim to reuse and recycle waste where possible, in accordance with good environmental practice.
Certain waste types are prohibited or restricted, including but not limited to asbestos, medical waste, clinical waste, biological waste, certain chemicals, solvents, gas bottles, explosives, and other hazardous or specialist materials. The Customer must clearly inform us in advance of any waste that may fall into a hazardous or regulated category.
If prohibited or hazardous items are discovered within the waste at the point of collection, we may refuse to remove them, may adjust the price to account for specialist handling and disposal, or may terminate the Services. The Customer is responsible for any additional costs incurred due to incorrect or incomplete information regarding waste types.
Once the waste has been loaded onto our vehicle and payment has been made or agreed in accordance with these Terms and Conditions, title to and risk in the waste transfer from the Customer to us. From that point, we are responsible for transporting, processing, recycling and disposing of the waste in compliance with applicable laws.
Before removal, the Customer remains responsible for the waste and any associated risks. The Customer must ensure that the waste is stored and presented in a safe and lawful manner up to the time of collection.
We will exercise reasonable care and skill in providing the Services. However, our liability to the Customer is limited to losses that are a foreseeable result of our breach of these Terms and Conditions or our negligence.
We are not liable for any indirect, consequential, or purely economic loss, including loss of profit, loss of business, or loss of opportunity, arising out of or in connection with the Services, whether in contract, tort or otherwise, except where such exclusion is not permitted by law.
Subject to any non-excludable rights under UK law, our total aggregate liability to the Customer in respect of any claim arising out of or in connection with the Services shall not exceed the total amount paid or payable by the Customer for the relevant Booking, unless otherwise required by law.
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
We will take reasonable care to avoid damage to property when carrying out the Services. The Customer is responsible for protecting any surfaces, fixtures, fittings or items that might be vulnerable during the removal process, and for informing us of any particular risks or fragile areas before work begins.
If damage occurs as a direct result of our negligence, the Customer must notify us in writing as soon as reasonably practicable and, in any event, within 7 days of the incident. We may request evidence, such as photographs or access for inspection, to assess the claim.
Where we are found to be liable for damage, our responsibility will be limited to the reasonable cost of repair or, where repair is not possible or reasonable, the reduction in value of the damaged item or area, subject always to the overall liability limitations set out in these Terms and Conditions.
The Customer and anyone acting on their behalf must treat our staff with respect and must not engage in abusive, threatening or inappropriate behaviour. We reserve the right to withdraw our Services, leave the site and, if necessary, contact the relevant authorities if our staff are placed at risk or subjected to unacceptable conduct.
The Customer must not instruct our staff to act in a manner that is unsafe, unlawful or contrary to waste regulations. Our team may decline to follow any such instruction and may terminate the Services if compliance would expose them or the business to unreasonable risk or legal breach.
We collect and process personal information required to manage Bookings, provide Services, take payment and communicate with Customers. We handle such information in accordance with applicable data protection laws in the United Kingdom.
We will only use Customer information for legitimate business purposes, such as fulfilling the Services, managing accounts, and complying with legal obligations. We will not sell personal data to third parties. We may share necessary information with service providers or authorities where required to deliver the Services or comply with legal or regulatory obligations.
We are not responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms and Conditions that is caused by events beyond our reasonable control. Such events may include, but are not limited to, extreme weather, road closures, accidents, vehicle breakdowns, industrial disputes, public health emergencies, or acts of government.
If an event beyond our control occurs, we will contact the Customer as soon as reasonably practicable to notify them and will take reasonable steps to minimise the impact on the Services. Where necessary, we will reschedule the Booking to a mutually convenient time.
We may update or amend these Terms and Conditions from time to time to reflect changes in our operations, relevant laws or regulations, or for other business reasons. Any updated Terms and Conditions will apply to new Bookings made after the date on which the revisions take effect.
For ongoing commercial arrangements, we will provide reasonable notice of any material changes. If the Customer continues to use our Services after the notified effective date of the revised Terms and Conditions, they will be deemed to have accepted the changes.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms and Conditions or their subject matter.
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be severed from the remaining provisions, which shall continue to be valid and enforceable to the fullest extent permitted by law.
These Terms and Conditions, together with any specific details agreed in writing at the time of Booking, constitute the entire agreement between Waste Clearance Clapham and the Customer in relation to the provision of the Services and supersede any prior understandings, agreements, representations or arrangements between the parties, whether written or oral.
No variation of these Terms and Conditions shall be effective unless it is made in writing and expressly agreed by an authorised representative of Waste Clearance Clapham.
